1. Acceptance of Terms
By downloading or using the Quartz app, you agree to be bound by these Terms and Conditions. If you do not agree, do not use the app. You must be at least 13 years old to use Quartz (16 in certain European jurisdictions).
2. Description of Service
Quartz is a focus timer application that helps users manage their work and break sessions. The app operates primarily on-device and does not facilitate transactions or interactions between users.
3. User Accounts
Quartz may offer optional account creation to sync settings or session history. If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us at [email protected] if you suspect unauthorized access.
4. User Responsibilities
You agree not to:
- Use the app for any unlawful purpose
- Attempt to reverse engineer, decompile, or modify the app
- Interfere with or disrupt the app's infrastructure
- Use the app in any manner that could damage, disable, or impair it
5. Intellectual Property
Gneiss Labs owns all rights to Quartz, including its design, code, trademarks, and content. You may not copy, modify, distribute, or create derivative works without written consent.
6. Disclaimer of Warranties
Quartz is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
7. Limitation of Liability
To the maximum extent permitted by law, Gneiss Labs's total liability for any claims arising from your use of Quartz is limited to the greater of amounts paid by you in the preceding 12 months or $10 USD. Gneiss Labs is not liable for any indirect, incidental, special, or consequential damages.
8. Termination
We may suspend or terminate your access to Quartz at any time for violations of these Terms. You may also delete your account at any time via the app's Settings.
9. Governing Law
These Terms are governed by the laws of the State of Delaware, USA. Users in the EU/UK retain mandatory consumer protection rights under their local laws.
10. Dispute Resolution
Please contact [email protected] first to resolve any issues informally. If unresolved within 30 days, disputes may be brought in Delaware courts, or your home jurisdiction if required by local law.
11. Changes to Terms
We may update these Terms from time to time. Changes will be posted in the app with at least 30 days' notice. Continued use after the effective date constitutes acceptance.
